Terms of Service

1. Agreement to these Terms

These Terms of Service (the “Terms”) govern your access to and use of Shareth, including its websites, short links, QR codes, text pastes, public profiles, APIs, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and our Acceptable Use Policy and acknowledge our Privacy Policy.

If you use Shareth for an organization, you represent that you have authority to bind that organization. In that case, “you” includes the organization. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 13 years old and legally able to enter into these Terms. If the law where you live requires a higher minimum age, that higher age applies. The Service is not directed to children under 13.

Provide accurate account information, protect your password and access tokens, and promptly tell us about suspected unauthorized access. You are responsible for activity through your account except to the extent caused by our breach of these Terms. We may require email verification or other reasonable checks.

3. The Service and short URLs

Shareth lets you create and manage links, dynamic QR destinations, pastes, profiles, and related analytics. A Shareth URL is a routing identifier, not ownership of a word, name, or internet address. We may reserve, reject, reclaim, or redirect aliases and handles that impersonate others, infringe rights, create confusion, are inactive, or interfere with the Service.

Destinations can change, and content may expire, be archived, disabled, moderated, or deleted. Do not rely on a Shareth URL as permanent storage or the only copy of important information. QR codes route through Shareth and therefore depend on the Service remaining available.

4. Your content and permissions

You retain ownership of content and links you submit (“User Content”). You grant Shareth a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, scan, and otherwise use User Content only as reasonably necessary to operate, secure, moderate, improve, and provide the Service. This license ends when the content is deleted, subject to reasonable backups, legal retention, and copies already shared by others.

You represent that you have the rights and permissions needed for your User Content and its destinations. You are solely responsible for their legality, accuracy, safety, and consequences. Shareth does not endorse User Content or third-party destinations.

5. Sharing and posting choices

New links and pastes stay out of Shareth Discover unless you explicitly post them. An unprotected share remains accessible to anyone who obtains its URL, including when you place it on your public profile. Content you post to Shareth appears with your public username and may be indexed or otherwise made broadly available. Password-protected and signed-in-only controls reduce access but cannot guarantee confidentiality. Recipients can copy, capture, or redistribute content.

Choose access and posting settings appropriate for what you share. Do not post secrets, credentials, regulated records, or sensitive personal information unless you have a lawful basis and accept the risks.

6. Acceptable use and enforcement

You must follow our Acceptable Use Policy and applicable law. We may investigate reports; block destinations; limit traffic; disable, quarantine, or remove content; suspend accounts; preserve evidence; and cooperate with lawful requests when reasonably necessary to protect users, Shareth, or others.

We may use automated and manual review. Enforcement decisions can be imperfect. Unless doing so would create risk or violate law, you may request review at [email protected].

7. Intellectual property

Shareth and its software, branding, designs, and documentation are protected by intellectual-property laws. Except for rights expressly granted in these Terms, we reserve all rights. You may not copy, reverse engineer, sell, or create derivative works from protected parts of the Service except where law permits it notwithstanding this restriction.

We respond to qualifying copyright notices and counter-notices. See our Copyright and DMCA Policy. Repeat infringement may result in account termination.

8. APIs, automation, and future integrations

Access tokens are confidential. You may use documented APIs for lawful integrations, including future browser-extension workflows, subject to published limits. You may not evade limits, scrape non-public data, automate abuse, interfere with the Service, or resell access without written permission. We may change or revoke API access to protect reliability and safety.

9. Service changes, availability, and beta features

We may add, change, suspend, or discontinue features. We aim to give reasonable notice of material changes when practical, but urgent security, abuse, or legal needs may require immediate action. The Service may experience interruption, delay, data loss, or errors.

Features identified as beta, preview, planned, or experimental may change or never launch and are provided for evaluation. You are responsible for maintaining backups and validating the Service for your needs.

10. Suspension and termination

You may stop using Shareth or delete your account through Settings. We may suspend or terminate access for violations, risk, prolonged inactivity, legal requirements, or discontinuation. Where appropriate, we will consider the severity, recurrence, and opportunity to cure.

On termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, disclaimers, limitations, indemnity, and dispute terms—will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SHARETH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED AVAILABILITY.

We do not warrant any user content, destination, analytics result, QR scan, delivery, or third-party service. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHARETH AND ITS OWNER, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID SHARETH FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited or to liability that cannot legally be limited.

13. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Shareth and its owner, affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your User Content, destinations, misuse of the Service, violation of these Terms, or infringement of another person’s rights. We may control the defense of a covered matter, and you agree to cooperate. This obligation does not apply to the extent a claim results from Shareth’s own unlawful conduct.

14. Disputes and applicable law

These Terms are governed by the laws applicable where the operator of Shareth is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Before filing a claim, you and Shareth agree to try in good faith for 30 days to resolve it by contacting [email protected]. Nothing here prevents either party from seeking urgent injunctive relief or using a qualifying small-claims process.

15. General terms

These Terms and the policies they incorporate are the entire agreement about the Service. If a provision is unenforceable, it will be modified only as much as necessary and the rest remains effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets.

We may update these Terms. Material changes will be announced through the Service or other reasonable means and will apply prospectively. Continued use after the effective date means you accept the revised Terms. Questions may be sent to [email protected].
